Terms of service

01The service

DarkGPT ("we", "us") provides the darkgpt.ai website, the DarkGPT P2P desktop app and the backend that coordinates them. The network itself is made of independent providers running the app on their own hardware. We coordinate discovery, updates, rewards and accounts; we do not operate the machines that run the models.

02Beta

The service is in beta. Features change, break and disappear. Data, balances and rewards may be reset. We may suspend or shut the service down at any time without notice. Do not build anything you depend on around it yet.

03Eligibility and accounts

You must be at least 18 and able to enter into a binding agreement. You are responsible for what happens under your account and for keeping your sign-in method secure. One person, one account. We may refuse, suspend or close accounts at our discretion, including for anything listed under acceptable use.

04Acceptable use

You may not use the service to:

• Break the law, or generate content that is illegal where you or the provider are located
• Produce or distribute child sexual abuse material, or content that sexualises minors, in any form
• Harass, threaten or defraud anyone, or impersonate a person or organisation
• Attack, probe, overload or interfere with the network, the backend, other clients or providers
• Attempt to read, intercept or retain other users' prompts or answers
• Circumvent limits, rewards logic, attestation or verification, or run modified provider software that misreports what it does
• Resell access without our written permission

The models on the network are third-party open-weight models. Some are uncensored. You are responsible for how you use what they produce.

05Providers

By switching the app to provider mode you agree to run it on hardware you own or are authorised to use, to keep it within the hardware trust boundary the app checks for, and to comply with the law where you are. You bear your own electricity, bandwidth and hardware costs.

You must not log, inspect, store, transmit or otherwise retain any prompt or answer that passes through your machine, and you must not modify the provider software to do so. Doing this ends your participation and forfeits unpaid rewards, and may expose you to liability to the people whose data you handled.

You may stop providing at any time by switching modes or quitting the app.

06Rewards

Rewards are paid in DCN on a test network. Test-network tokens have no monetary value, cannot be exchanged for money, and may be reset, reissued or abandoned at any time. Reward rates, eligibility and the program itself may change or end without notice. Nothing on the site or in the app is a promise of income; figures shown are estimates from measured throughput at the current rate.

Purchases are disabled during the beta. If enabled, they will carry their own terms.

07Model output

Answers come from open-weight models run by independent providers. They can be wrong, outdated, biased or harmful. They are not professional advice of any kind. Do not rely on them for medical, legal, financial, safety-critical or other consequential decisions without independent verification. We make no promise about the accuracy, availability or fitness of any answer.

08Intellectual property

The DarkGPT client and provider code is released under the MIT licence; the licence governs your use of the code. The DarkGPT name, logo and site content are ours. Model weights belong to their respective publishers under their own licences. You keep whatever rights you have in your prompts, and you grant providers and us only the rights needed to process them and return an answer.

09Privacy

Our privacy policy explains what we collect and what providers can and cannot see. It is part of these terms.

10Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY OR SECURITY. WE DO NOT WARRANT THAT PROVIDERS WILL BEHAVE AS REQUIRED, THAT THE NETWORK WILL BE AVAILABLE, OR THAT ANY REWARD WILL BE PAID.

11Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR CONTRIBUTORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, TOKENS OR GOODWILL, ARISING FROM THE SERVICE, THE NETWORK, ANY PROVIDER OR ANY MODEL OUTPUT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS OR ONE HUNDRED US DOLLARS. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO SOME MAY NOT APPLY TO YOU.

12Indemnity

You will defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your use of the service, your content, your conduct as a provider, or your breach of these terms.

13Termination

You can stop using the service at any time and ask us to delete your account. We can suspend or terminate your access at any time for any reason, with or without notice. Sections on intellectual property, disclaimers, limitation of liability, indemnity and governing law survive termination.

14Governing law and disputes

These terms are governed by the laws of the United States and the state in which we are established, without regard to conflict-of-law rules. Disputes will be brought in the courts of that state. Before filing, contact us and give us 30 days to resolve the matter informally.

15Changes and contact

We may update these terms. Material changes will be noted on this page and in the release log before they take effect; continuing to use the service after that means you accept them. Questions: the DarkGPT Discord.
